On October 2, 2025, Commonwealth filed a request for an extension of time, seeking approximately four years to complete construction and place the project into service.
The original order required Commonwealth to complete construction of its project and place it into service within five years of the date of the order, or by November 17, 2027.
Commonwealth said that the project had been delayed primarily due to litigation surrounding the order and the delay in receiving a non-free trade agreement (non-FTA) export authorization from the US Department of Energy (DOE).
On October 7, 2025, FERC issued a public notice of Commonwealth’s request for an extension of time, with interventions, comments, and protests due by October 22, 2025.
According to the regulator, no interventions, comments, or protests were filed.
“Based on the facts presented in the request and the case record, Commonwealth is granted an extension of time until and including December 31, 2031, to complete construction of its project and make it available for service,” FERC said.

Commonwealth has not yet taken a final investment decision on its project.
The US LNG developer previously said it plans to decide on the facility by the end of this year and has received approval from FERC to begin initial site preparation activities.
However, a Louisiana state court recently vacated the coastal use permit for Commonwealth’s planned in Louisiana.
Following this, Commonwealth told FERC in its newest monthly status report that the project is “working with our state officials and regulators to resolve this matter as quickly as possible, while ensuring our permit record fully demonstrates the project’s compliance with all regulatory criteria.”
“The project will notify the Commission when the permit is reissued. Site preparation activities will not be initiated until such time,” Commonwealth said.
As per the offftake side, the company has entered into long-term sale and purchase agreements with Petronas for 1 mtpa of LNG, Glencore for 2 mtpa of LNG, Jera for 1 mtpa of LNG, and EQT for 1 mtpa of LNG.
Additionally, Commonwealth has authorized an order for six Baker Hughes refrigerant turbo compressors required for the liquefaction process of its LNG export project.
The order will be placed by Technip Energies, which Commonwealth announced will lead the engineering, procurement, and construction (EPC) execution of its LNG facility.
